Gujarat students will not lose the seats they got through the now-defunct upper caste quota, says SC
The apex court made an exception for them though the High Court had quashed the government's 10% reservation policy.
Students admitted under the Gujarat government's 10% reservation policy for economically backward upper castes will not be affected by the state High Court's order scrapping the reservation, the Supreme Court ruled on Friday. However, the bench led by Chief Justice of India TS Thakur said the state should not try to revive the quota in the future, reported The Hindu. The court admitted a petition by the state government challenging the High Court order and referred it to a five-judge Constitution bench.
"Until further orders of the court, we direct that admissions made to any educational institutions prior to the pronouncement of the High Court order shall not be disturbed," the court said.
On August 4, the Gujarat High Court had revoked the state government's notification granting 10% reservation for the economically backward among upper castes in educational institutions. The government had granted the quota to help families with an annual income of less than Rs 6 lakh per annum.
