DMK challenges suspension of its MLAs from Tamil Nadu Assembly in high court: Times of India
Advocates have also asked the court to quash Section 121 of the legislative assembly rules that allows legislators to be suspended for an entire session.
The Dravida Munnetra Kazhagam on Friday challenged the suspension of 79 of its MLAs by the Tamil Nadu Assembly Speaker P Dhanapal in Chennai High Court and sought an urgent hearing. Advocates Mohan Parasaran and NR Elango also asked the court to quash the "unconstitutional" Section 121 of Tamil Nadu Legislative Assembly Rules that allows legislators to be suspended for an entire session.
The bench of Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan, however, refused their plea for an urgent hearing and asked them to file an affidavit, reported The Times of India.
The petitioners have argued that the suspension was "unprecedented". Leader of Opposition MK Stalin said, "It appears to be an elaborate plan designed to deprive members of DMK party of an opportunity to engage in debates and proceedings in the forthcoming week in which the House is expected to pass vital Bills and Budget proposals."
On Wednesday, all 79 DMK legislators present in the Tamil Nadu Assembly were evicted and suspended for a week after chaos that followed a mocking remark made about Opposition leader MK Stalin’s 'Nammaku Naame' roadshow.
